1. Agreement to Terms

By downloading, installing, or using SnackSmart ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

SnackSmart grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

You May:

Use the App on your personal iOS devices
Access features included in your subscription tier (Free or Premium)
Sync data with Apple Health (HealthKit)
Export your personal data (Premium feature)

You May Not:

Reverse engineer, decompile, or disassemble the App
Use the App for commercial purposes without permission
Remove, modify, or obscure any copyright or proprietary notices
Share your Premium subscription with others (subject to Family Sharing rules)
Abuse the AI recognition system with inappropriate content

3. Subscription Terms

Free Tier

Unlimited food scans with AI recognition
Basic nutrition tracking
HealthKit sync
Supported by advertisements (displayed every 7 scans)
No payment required

Premium Tier

Monthly Subscription: $2.99 USD/month

Yearly Subscription: $19.99 USD/year (save 44%)

Premium Benefits:

Ad-free experience
Unlimited scan history
Advanced nutrition analytics
Data export (CSV/PDF)
Custom dietary filters
Priority AI processing

Billing and Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
You can manage or cancel your subscription in iOS Settings → [Your Name] → Subscriptions
No refunds for partial subscription periods
Subscriptions are processed through Apple's App Store (subject to Apple's Terms and Conditions)

Free Trials

If we offer a free trial period:

You will be charged the subscription price after the trial period ends
You can cancel anytime during the trial to avoid charges
Free trials are typically available to new subscribers only
Previous subscribers may not be eligible for free trials

Family Sharing

Premium subscriptions support Apple Family Sharing:

Share your Premium subscription with up to 5 family members
Each family member has their own private nutrition data
Subject to Apple's Family Sharing terms and conditions

4. User Content

Your Data

You retain all rights to the food photos, nutrition records, and other content you create using SnackSmart ("Your Data").

Data Storage

Your Data is stored locally on your device
We do NOT upload or store Your Data on our servers
You are responsible for backing up your device to preserve Your Data
Deleting the App will permanently delete Your Data from your device

Appropriate Use

You agree to use the App's AI recognition features appropriately:

Only scan food and nutrition-related items
Do not scan inappropriate, offensive, or illegal content
We reserve the right to restrict access if abuse is detected

5. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key Privacy Principles:

All nutrition data is stored locally on your device
No personal data uploaded to servers
Free tier users see ads from Google AdMob
Premium users have ad tracking completely disabled
You can delete all data by deleting the App

6. HealthKit Integration

SnackSmart integrates with Apple HealthKit to sync nutrition data:

HealthKit access requires your explicit permission
You can revoke HealthKit access anytime in iOS Settings
Nutrition data syncs locally between SnackSmart and the Health app
We do NOT access other health data beyond what you explicitly grant
HealthKit data never leaves your device

7. Disclaimers

⚠️ Important: SnackSmart is a nutrition tracking tool for informational purposes only. It is NOT medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before making dietary changes, especially if you have medical conditions or dietary restrictions.

AI Recognition Accuracy

AI food recognition is powered by machine learning and may not be 100% accurate
Nutrition values are estimates based on typical food compositions
Always verify critical nutrition information with official sources
You can manually adjust AI-generated values if needed

Service Availability

We strive to keep SnackSmart available 24/7, but we do not guarantee uninterrupted service. We may:

Perform maintenance or updates
Experience technical difficulties
Modify or discontinue features (with notice when possible)

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SnackSmart is provided "AS IS" without warranties of any kind
We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for Premium subscriptions in the last 12 months
We are not responsible for data loss (back up your device regularly)

9. Intellectual Property

SnackSmart, including its design, features, code, and content, is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, or distribute the App
The SnackSmart name and logo are trademarks
Third-party services (Apple, Google) have their own terms

10. Third-Party Services

Apple Services

SnackSmart uses Apple services including:

App Store (app distribution, subscriptions)
HealthKit (nutrition data sync)
Vision Framework (AI food recognition)
Speech Recognition (voice logging)

These services are subject to Apple's Terms and Conditions.

Google AdMob (Free Tier Only)

Free tier users see advertisements powered by Google AdMob:

Ads are displayed every 7 scans
Subject to Google's Privacy Policy and Terms
You can opt-out by upgrading to Premium

11. Termination

By You

You can stop using SnackSmart anytime by:

Deleting the App from your device
Canceling your Premium subscription in iOS Settings

By Us

We reserve the right to suspend or terminate your access if you:

Violate these Terms of Service
Abuse the AI recognition system
Engage in fraudulent activity
Use the App for illegal purposes

12. Changes to Terms

We may update these Terms from time to time. When we do:

We will update the "Last updated" date
Material changes will be notified in-app
Continued use after changes constitutes acceptance
If you don't agree, please stop using the App

13. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
