1. Agreement to Terms

By downloading, installing, or using TimeKit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

TimeKit grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or professional time tracking purposes, subject to these Terms.

You May:

Use the App on your personal iOS devices
Access features included in your subscription tier (Free or Premium)
Track time for personal productivity or client billing purposes
Export your time tracking data (Premium feature)
Sync data across devices with iCloud (Optional, Premium feature)

You May Not:

Reverse engineer, decompile, or disassemble the App
Sell or redistribute the App without permission
Remove, modify, or obscure any copyright or proprietary notices
Share your Premium subscription outside of Family Sharing
Use the App for illegal time tracking or fraudulent billing

3. Subscription Terms

Free Tier

Track time with up to 3 categories
Basic timer functionality (start, stop, pause)
View daily and weekly summaries
Manual time entry
No payment required
No advertisements (Free tier is ad-free)

Premium Tier

Monthly Subscription: $2.99 USD/month

Yearly Subscription: $24.99 USD/year (save 31%)

Premium Benefits:

Unlimited categories/projects
PDF invoice reports for client billing
Advanced analytics and insights
Goal tracking and productivity targets
iCloud sync across devices
CSV data export
Pomodoro timer (Premium)
Break reminders (Premium)
Widgets for iOS home screen & lock screen

Billing and Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
You can manage or cancel your subscription in iOS Settings → [Your Name] → Subscriptions
No refunds for partial subscription periods
Subscriptions are processed through Apple's App Store (subject to Apple's Terms and Conditions)

Free Trials

If we offer a free trial period:

You will be charged the subscription price after the trial period ends
You can cancel anytime during the trial to avoid charges
Free trials are typically available to new subscribers only
Previous subscribers may not be eligible for free trials

Family Sharing

Premium subscriptions support Apple Family Sharing:

Share your Premium subscription with up to 5 family members
Each family member has their own private time tracking data
Subject to Apple's Family Sharing terms and conditions

4. User Content

Your Data

You retain all rights to the time tracking data, categories, reports, and other content you create using TimeKit ("Your Data").

Data Storage

Your Data is stored locally on your device
We do NOT upload or store Your Data on our servers
You are responsible for backing up your device to preserve Your Data
Deleting the App will permanently delete Your Data from your device
If you enable iCloud sync, Your Data is also stored in your personal iCloud account

Appropriate Use

You agree to use TimeKit for legitimate time tracking purposes:

Track time honestly and accurately
Do not use the app for fraudulent billing or time theft
Comply with employment laws and client agreements
We reserve the right to restrict access if abuse is detected

5. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key Privacy Principles:

All time tracking data is stored locally on your device
No personal data uploaded to servers (unless you enable iCloud sync)
No advertisements or ad tracking
No third-party analytics or data sharing
You can delete all data by deleting the App

6. Disclaimers

Accuracy of Time Tracking

⚠️ Important: TimeKit is a time tracking tool that relies on you to start and stop timers accurately. While we strive for accuracy, we cannot guarantee perfect time tracking in all circumstances (e.g., app crashes, device restarts, background limitations). Always review your time entries before billing clients or submitting timesheets.

Not Legal or Financial Advice

TimeKit provides time tracking tools, not legal or financial advice
Consult with qualified professionals for tax, billing, or employment law questions
We are not responsible for billing disputes or employment issues
You are responsible for complying with applicable laws and regulations

Service Availability

We strive to keep TimeKit available 24/7, but we do not guarantee uninterrupted service. We may:

Perform maintenance or updates
Experience technical difficulties
Modify or discontinue features (with notice when possible)

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

TimeKit is provided "AS IS" without warranties of any kind
We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for Premium subscriptions in the last 12 months
We are not responsible for data loss (back up your device regularly)
We are not responsible for billing disputes with your clients
We are not responsible for employment or legal issues arising from time tracking

8. Intellectual Property

TimeKit, including its design, features, code, and content, is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, or distribute the App
The TimeKit name and logo are trademarks
Third-party services (Apple) have their own terms

9. Third-Party Services

Apple Services

TimeKit uses Apple services including:

App Store (app distribution, subscriptions)
iCloud (optional data sync)
StoreKit (subscription management)
UserNotifications (reminders and alerts)
WidgetKit (home screen widgets)
MetricKit (anonymous analytics)

These services are subject to Apple's Terms and Conditions.

10. Termination

By You

You can stop using TimeKit anytime by:

Deleting the App from your device
Canceling your Premium subscription in iOS Settings

By Us

We reserve the right to suspend or terminate your access if you:

Violate these Terms of Service
Use the App for fraudulent billing
Engage in abusive behavior
Use the App for illegal purposes

11. Changes to Terms

We may update these Terms from time to time. When we do:

We will update the "Last updated" date
Material changes will be notified in-app
Continued use after changes constitutes acceptance
If you don't agree, please stop using the App

12. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
